Staying on Track: Renegotiating Transport Contracts
The Supreme Court has recently refused to grant an injunction sought by a transport company to prevent a (former) customer moving its business to a new company.
In a preliminary hearing, the Supreme Court of New South Wales dismissed an application to prevent Dairy Farmers from reallocating distribution services as it was not "seriously arguable" that the existing contracts had been extended.
The case is a reminder of the care that is required in contractual re-negotiations, and that nothing should ever be taken for granted.
