Norton White Insolvency Update - November 2006
Norton White's latest Insolvency Update is attached. It contains: a report on a very recent case where the Court considered when the pooling of assets of a group of companies in liquidation will be allowed; a note on the ACCC and ASIC's Debt Collection Guidelines; a summary of Young v Commissioner of Taxation (2006) 56 ACSR 654 where the Court considered whether it was proper to enter judgment by agreement between the plaintiff and the defendant in preference actions without the necessity of the plaintiff being required to formally prove each element of such an action.
Our update also includes a profile of our newest partner, Lou Le Compte. Lou is a senior solicitor who practices in a number of areas including insolvency, banking & finance and property & property development.
