Damages for Late Redelivery - Subsequent Charter Hire
Transfield Shipping Inc v Mercator Shipping Inc (The "Achilleas") [2007] 1 Lloyd's LR 19
In this case, Charterers were ordered to pay US$1,364,584.37 in damages for late redelivery. This decision appears to be the first in which a Court has awarded damages for the loss of a subsequent charter party for the late redelivery of a vessel. The recognition of this class of damages represented an increase in the award of US$1,206,247.20, a significant figure which Charterers will need to bear in mind.
